Terms of Service

1. Acceptance of Terms
By accessing or using BeSpoke (the "Service"), operated by Mina Logic ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
BeSpoke is a cloud-based tailoring business management platform that provides tools for order management, customer management, measurement tracking, payment processing, inventory management, and business analytics. The Service includes an admin portal for shop owners and staff, and a customer portal for end clients.
3. Account Registration
- You must provide a valid phone number to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old to use the Service.
- You agree to provide accurate and complete information.
- One person may not maintain more than one account without authorization.
4. Shop Owner Responsibilities
If you register as a shop owner, you agree to:
- Use the Service only for lawful business purposes.
- Obtain appropriate consent before entering customer personal data and measurements.
- Keep customer data accurate and up to date.
- Not share login credentials with unauthorized individuals.
- Manage your staff accounts and permissions responsibly.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to access data belonging to other shops or users.
- Upload malicious code, viruses, or harmful content.
- Interfere with or disrupt the Service or its infrastructure.
- Resell, sublicense, or redistribute the Service without permission.
- Scrape, data-mine, or extract data from the Service by automated means.
6. Subscription & Payments
- The Service offers free and paid tiers. Features vary by tier.
- Paid subscriptions are billed monthly or annually as selected.
- Prices may change with 30 days' notice.
- Payment processing is handled by third-party providers (e.g., Paystack). Their terms apply to all transactions.
- Platform commissions on processed payments, if applicable, are deducted automatically.
7. Data Ownership
- Your Data: You retain all rights to the data you input into the Service (customer records, orders, measurements, etc.).
- License to Us: You grant us a limited license to process, store, and display your data solely for the purpose of providing the Service.
- Aggregated Data: We may use anonymized, aggregated data for analytics, benchmarking, and improving the Service.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime.
9. Intellectual Property
The Service, including its design, code, features, and branding, is owned by Mina Logic and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind.
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
- We are not liable for errors in data entered by users or for business decisions made based on Service data.
11. Termination
- You may terminate your account at any time by contacting us.
- We may suspend or terminate accounts that violate these Terms.
- Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.
- Provisions relating to intellectual property, liability, and dispute resolution survive termination.
12. Dispute Resolution
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled by arbitration in Accra, Ghana.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via the Service or email with at least 14 days' notice. Continued use after changes take effect constitutes acceptance.
